1. TERMS AND CONDITIONS

Easy Bath is a division of Terranova Construction Kitchen and Bath, Incorporated and is located at 8032 Leesburg Pike in Tysons Corner, Virginia 22182. Terranova possess a Class A Contractor License in the Commonwealth of Virginia (2705052595A). Easy Bath has tailored software to create its Web site content to serve the bathroom remodeling industry. Customers using this website for the express purpose of placing an order, or save selected information must adhere to the terms and conditions which are presented below. Product specifications
Easy Bath is committed to installing high quality materials at the best prices available. From time to time, specifications change and materials/fixtures shipped are not exactly the same as materials/fixtures ordered. In some cases materials/fixtures ordered are discontinued or back-ordered, which might delay your project. Through no fault of Easy Bath, products and materials supplied to the customer might differ from what you may have seen on-line, in our showroom, or somewhere else on display. Should this occur, Easy Bath will ensure to the customer that the products supplied will be of equivalent in price, functionality and style. Marble and granite and all tiles are made from natural products. That means there is likely to be some variation in colors and textures, even when materials are derived from the same quarry or same lot. It is this variation that produces the beauty in your new bathroom, no matter what product is chosen. Easy Bath will represent on the Web site the colors of products that it will make available to customers in the combination packages. However, these representations may differ slightly or completely from the colors of the materials actually ordered and delivered. Easy Bath cannot guarantee the complete accuracy of the pictures or photographs which appear on your computer screen or printed from our Web site.

Pre-construction visit
To ensure that your bathroom project gets the attention it deserves and will meet your expectations when completed, Easy Bath requires a pre-construction visit at the customer’s residence to confirm measurements, review the proposed floor plan, and review the combination selected for the bathroom remodeling. The cost of the home visit is $200 and it is applied toward the bathroom remodeling last payment if Easy Bath is hired to do the project; if you do not select Easy Bath to do the remodeling job, the customer agrees that the $200 fee will not be refunded. The dimensions we specify are estimates only; dimensions are subject to change when our crew begins work. It is possible that decisions might have to be made in the field that requires changes to the original dimensions provided.

Deliveries and promotions
Materials for your bathroom remodeling project will be delivered to your home on weekdays and/or weekends. Delivery is usually made by Easy Bath staff; however, at times a distributor or trucking company will make the delivery. Promotion pricing will terminate at midnight of the expiring date. We will not be bound to honor any prices and /or promotions, where we have indicated subsequently that the prices displayed have been displayed in error.

Returns, your right to cancel and change orders
For purposes of these Terms & Conditions, customers shall have up to 72 hours (3 days) from execution of the contract to cancel their contract without any penalty. They shall notify Easy Bath by e-mail of such cancellation and return the contract to Easy Bath in person or by mail within the 72 hour period (if the latter, the envelope must be postmarked by the end of the 72 hour period). Easy Bath will return any deposit it has received once payment has been credited to our account, and the customer has returned any materials borrowed from Easy Bath. If the contract is cancelled after 72 hours from execution of the contract, the customer may be charged for restocking fees, materials already ordered, installation crew schedule compromises, and profit lost. Customers may also be charged in full for materials that cannot be returned to distributors or manufacturers. Easy Bath will send you a refund within sixty (60) days of your notice. Please keep the products purchased in a saleable condition and retain the original packaging in the condition it was provided. If Easy Bath or its designee delivers incorrect or damaged materials, or the customer finds any defects for which she/he requires compensation or other form of remedy, the customer must report such defect within 24 hours of receiving the defective goods by calling Easy Bath at 877 4EZ BATH (877 439 2284). All modifications to the contract must be done in the form of change of orders. All change of orders must be paid in full before they can be implemented.

Delivery and job completion time
If the customer needs to make changes to the content of its order, Easy Bath cannot guarantee that the installation completion date will remain as originally planned. The customer is responsible for providing a safe means of accessing and exiting your property. If our, or other, delivery staff considers that access is unsafe then we will not deliver the goods until safe access is provided and the customer will be charged for a new delivery. If Easy Bath accidentally damages product or property inside the customer’s residence in the course of delivery or bathroom installation process, our liability for that damage is limited to the repair or replacement of the goods at the sole option of Easy Bath,.

Installation
Easy Bath will make every effort possible to begin your project on the estimated start date, and complete your project within 14 working days. Qualified workmanship and trustworthy staff will begin and complete your job on time. From time to time we can not finish the job within the 14 working days because materials are missing, backordered, broken and consequently uninstalled. Easy bath guaranties will deliver a functional bathroom at the end of the 14th working day. Functional bathroom is defined as a stage of the installation process where people can use the bathroom appliances (shower, and/or bathtub, and toilet, and sink) but one or more of the bathroom finish materials (mirrors, lights, shower enclosure, functional or cosmetic parts of faucet/s, are not installed, and/or missing, and/or backordered.

Warranty
Should a defect in workmanship appear Easy Bath will at its option repair or replace the defective work at no charge to the customer so long as the defect is discovered within 12 months of the actual date the job is completed. This warranty does not cover normal wear and tear, neglect, abuse or misuse of products and materials, loss or damage due to fire, smoke, water, lightning, sunlight, weather, rusting, corrosion, theft or explosion, accidental damage or loss or damage caused by a third party. Should a part no longer be available, it will be replaced with a part that most clearly matches it. This is a limited warranty. No other warranty is expressed or implied. This warranty is not transferable to any subsequent owner of the premises. Easy Bath shall not be liable for any incidental, consequential or special damages which may result from any breach of contract or the warranty provisions therein. We will not be liable for any direct or indirect loss of profits or other consequential or incidental loss or damage arising out of defective, damaged or wrongly delivered products over and above the value of the goods themselves. All warranties of the manufacturer on goods and equipment will be provided to the customer and the customer’s sole and exclusive remedy for any defect in such goods or equipment or damages caused by such goods and equipment shall be against the manufacturer.

Website content disclaimers
Easy Bath will monitor its on-line pricing periodically so that information is correct and current. However, Easy Bath will not be responsible for any negative consequences originating from such inaccuracies. To the maximum extent permissible by law, we exclude all warranties, express or implied as to the accuracy of the information contained in any of the materials on this website. We cannot accept liability for any particular material on the Website or as a result of any use of or reliance placed upon the information contained on this Website. Any material downloaded or otherwise obtained through the use of this Website is done at your own discretion and risk and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material. Easy Bath cannot ensure the accuracy and timeliness of any information obtained from visiting other Websites via Easy Bath’s provided links.

Data protection
For its e-commerce business, Easy Bath has selected a prominent third party encryption service to protect any unauthorized release of customer’s personal identifiers, including their credit/debit card numbers as part of an Easy Bath transaction with its customers. Only when a release of such information is pre-approved by the customer and the release is for the intended purpose of the business transaction.

Protecting your privacy
One of the requirements for using this Website is to enter personal data. For example, the customer must provide Easy Bath its name and e-mail address. Easy Bath will not relinquish personal identifiers; they will remain confidential.

Safety on-line
Whenever you provide us with personal information, we offer the use of a secure server. If the browser you are using is 'security-enabled' (such as Microsoft Internet Explorer version 2.1 or greater, or Netscape Navigator version 2.0 or greater), the information you send us regarding your purchase will be encrypted. This makes it extremely difficult to read even if it is wrongly intercepted. We use the industry-standard Secure Sockets Layer (SSL) technology for the encryption of potentially sensitive information such as the customer name and address, and credit card numbers.

2. PLACING THE ORDER & PAYING FOR YOUR ORDER

We shall acknowledge receipt by e-mail of the order to the customer without undue delay; and make available the technical steps allowing the customer to identify and correct input errors prior to the placing of the order.

Scheduling your remodeling project
Upon placing your order the customer has the option to suggest the starting time for the project. This date shall be confirmed once the order is accepted. Once the order is place Easy Bath will visit your property to double check the dimensions and your selections. You shall receive a copy of the contract, which will include the scheduled starting date.

You can pay on-line
Once registered with Easy Bath the customer can process deposits payments, progress payments or final payments on-line.

You can also pay by phone
If you prefer to pay by phone, please feel free to call us at 877 4EZ BATH (877 439 2284) between 9am and 5pm, Monday to Friday.

Payment schedule
The payment schedule is 50% of the total amount agreed is required at execution of the contract, and the final 50% at the completion of the job. We reserve the right to obtain validation of your credit charge or debit card details before accepting your order. The contract will be considered accepted only after Easy Bath’s account has been credited with the initial deposit of 50% and the selection of your combination has been approved by our staff. If we for any reason cannot accept your order, we will notify you as soon as possible, nullify our contract with you, and return any payment you have made to Easy Bath (after it has cleared our bank account). A handling fee of $100 will be assed to all returned checks.

3. DISCLAIMERS

If your bathroom is bigger than 54 square feet
Easy Bath bathroom remodeling combos are priced on the basis of 54 square feet or less. We will work in bathrooms that are bigger than 54 square feet for an extra cost.

Easy Bath responsibilities
Easy Bath respects all property in which it conducts business. The company will care for your home from start to finish. Our workers will care for the areas in which they are working as well as the areas they must travel through to reach the bathroom renovation. Easy Bath will protect the access path to the jobsite and will keep this area as clean as practicable. As necessary, work areas may need to be draped with plastic to prevent dust from reaching other rooms. Dents originated by our installation crew to surfaces in or outside our working area will be repaired.

If your are not the property owner
Please let Easy Bath know if you do not own the property where the remodeling job is going to take place. If you are not the legal property owner you will need to get a release or Power of Attorney from the legal property owner.

Lead paint disclosure
If the home Easy Bath is remodeling was constructed before 1979 there is a distinct possibility that lead paint was used inside and/or outside the home. The homeowner is responsible to communicate to Easy Bath that the home predates 1979. Easy Bath shall take all necessary precautions to handle the lead based paints for an extra cost to the homeowner. This particular handling shall delay the completion of the job. Easy Bath can not assume any responsibility for any consequences resulting from scraping any walls or ceilings during the remodeling of bathrooms in such homes.

Hidden damage found during installation
Easy Bath is not responsible for damage found behind walls and/or floors, and/or ceilings, and/or moldings, etc. Easy Bath will bring this hidden damage to the attention of the customer. Easy Bath will repair the damage at an extra cost payable before the repairs are initiated. The estimate for repairing the damage will be assembled by an Easy Bath agent, and presented in a change order to the customer for his/her signature. Without a signed and paid change order Easy Bath cannot proceed with any repair work in such property. Easy Bath assumes no responsibility for any delay the repairs may cause to the completion time.

Natural stone, ceramic tile, porcelain tile, and wooden products
Easy Bath cannot ensure the customer that natural stone, or ceramic tile, or porcelain tile, or wooden products will be uniform in color, texture, thickness, dimension, striation, veining, and/or graining, Such variations are considered acceptable.

Tile spacing and grout colors
All spaces between tiles and grout color are determined by Easy Bath. If the customer wishes to change the grout color or tile’s spacing, this must be approved by Easy Bath before the job begins. Once the job has started there shall not be any tile spacing or grout color changes accepted.

Main water shut-off valve
The house main water shut-off valve needs to be turned off to work on your bathroom’s water feeding lines. Easy bath shall not be found responsible if such valve breaks or malfunctions while or after it is used by Easy Bath workers. Easy Bath could replace the deteriorated, malfunctioning or broken main shut-off valve for an extra cost. In order to replace the valve the corresponding change order needs to be signed by customer and the street shut-off valve needs to be turned off (street water shut-off is typically owned and operated by the local water company).

Other customer’s responsibilities
Before Easy Bath begins work, please remove any breakables, pictures and all furniture which are in the pathway to the bathroom being remodeled and make sure that you have provided a house key to us, so our installation crew has access to your home. Easy Bath workers will make sure that the door by which they entered your property is locked each day when they leave. All customers shall designate an area in the property for storage of the materials and tools that will be used for the project.

If you reside in a condominium Easy Bath will need
Written approval from the condominium homeowner association before the project can begin.
A direct telephone number to the building engineer.
The location of the loading dock, the hours of operation of the service elevator, and two parking spaces reserved for our installation crew.

If someone in the family has allergies
Easy Bath recommends that anyone with known allergies stay away from the worksite until the project is completed.

If there are family pets
Please take steps to confine pets to areas of the property unaffected by our remodeling project until it is completed.

If your property is outside our radius of operation
Easy Bath is expanding its operational area as soon as it is possible. We limit subscription to our bathroom remodeling programs by zip codes. Please, call us to learn more at 877 4EZ BATH (877 439 2284).
